Competition Terms and Conditions
- Introduction
These terms and conditions ("Terms") govern the registration of interest in the RCA Shootout ("Competition") organised by MMR International Pty Ltd (ACN 675226490), trading as RCA ("Organiser"). By registering your interest, you agree to comply with these Terms.
- Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your participation in the Competition shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
- Eligibility
To register for the Competition:
- Participants must hold a valid international competition C-grade licence.
- Participants must be at least 16 years of age at the time of registration.
- Registration is open to individuals worldwide, except for employees of the Organiser, their immediate families, and anyone otherwise connected with the organisation or judging of the Competition.
- Registration Period
Registration opens on 5th September 2024 and closes on 1st November 2024. Any entries received after this period will not be considered.
- Registration Process
- Participants must register their interest online at https://www.roadcourseacademy.com/shootouts.
- Each participant may only register once. Multiple registrations by the same participant will result in disqualification.
- There is no fee to register your interest. However, if you are selected to participate in the Competition, a non-refundable entry fee of €20,000 must be paid to confirm your place.
- Minimum Participation Requirement
The Competition will only proceed if a minimum of 20 drivers successfully register and pay the entry fee. If the minimum number of participants is not met, the Organiser reserves the right to cancel the Competition.
- In the event of cancellation due to insufficient registration, the Organiser shall not be liable for any expenses, losses, or damages incurred by participants, including but not limited to travel and accommodation costs.
- Selection Process
Participants will be selected by a panel of judges based on their driving experience, future goals, and aspirations.
- The Organiser will notify selected participants by email. Selected participants must confirm their participation and pay the entry fee within the timeframe specified in the notification email.
- Participant and Winner Obligations
- Participants selected to compete in the RCA Shootout must cover their own travel and accommodation costs to the event locations in Italy.
- The Winner of the Competition must also cover all travel, accommodation, and any additional expenses related to their participation in the GT Cup Italia series.
- The Winner is responsible for providing homologated driver gear, including a fully functional radio headset.
- The Winner of the Competition will win one seat in a shared car in the GT Cup Italia series, where two drivers share the same car.
- The driver/competition entrant and/or the winner is liable for all damages to the car caused by them or due to a race incident on track during their participation in the Competition and the GT Cup Italia series.
- The Winner is also responsible for any damage incurred and all associated insurance costs during their participation in the Competition and the GT Cup Italia series.
- The Organiser will not provide refunds for the entry fee or any other expenses if a participant fails to win the Competition.
- Indemnity
By registering for the Competition, participants agree to indemnify and hold harmless the Organiser, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or in connection with their participation in the Competition or any breach of these Terms.
- Data Protection and Privacy
- The Organiser will collect participants' names, email addresses, and driving history during the registration process.
- This data will be retained for one year and will be used solely for the purposes of administering the Competition.
- By registering, participants consent to their data being used in accordance with the Organiser's Privacy Policy.
- Promotional Use
By registering, participants agree to the Organiser using their names, images, and any other relevant details in promotional material related to the Competition, without further compensation.
- Liability
- The Organiser does not guarantee that all who register their interest will be selected to participate.
- The Organiser shall not be liable for any travel or accommodation expenses, entry fees, or other costs incurred by participants.
- The Organiser reserves the right to cancel the Competition if necessary, provided that the event has not yet taken place or if the minimum number of participants is not met.
- Force Majeure
The Organiser shall not be liable for any failure to fulfil its obligations under these Terms due to circumstances beyond its control, including but not limited to natural disasters, acts of God, war, or pandemics.
- Amendments
The Organiser reserves the right to amend these Terms at any time. Any amendments will be communicated to participants via the Competition website or email.
- Dispute Resolution
Any disputes arising out of or in connection with these Terms shall first be resolved through negotiation. If the dispute cannot be resolved within 30 days, it shall be referred to mediation in accordance with the guidelines set out by the Australian Dispute Resolution Association (ADRA).
